The products marketed on the www.zegna.com website (hereinafter, the “Website”) are sold and invoiced by Ermenegildo Zegna Handelsgesellschaft m.b.H., a company having its registered office in Tuchlauben 7, 1010 Wien, Austria, VAT number AT U14280703 (“ZEGNA”)

For any information on purchase orders, deliveries and, more in general, purchases, please contact Zegna customer care at the following addresses:

 

1. Acceptance of the general conditions of sale and closing

1.1 ZEGNA offers for sale on the Website the products to end consumers, namely, to persons who buy them for purposes that are outside its trade or business (“Customer”). ZEGNA reserves therefore the right not to process orders placed by persons other than a consumer. 

1.2 The contract executed between ZEGNA (hereinafter also the “Seller”) and Customer shall be deemed consummated upon acceptance of the order, including partial acceptance, by ZEGNA. If the order is not accepted by ZEGNA, ZEGNA shall immediately inform Customer thereof. 

1.3 By placing an order in accordance with the envisaged modalities, and with the order form made available on the Website (hereinafter, the "Order"), Customer declares that it has read and understood all of the indications given during the purchase procedure, and the same is accepting in full these general conditions (hereinafter, the "Conditions"). 

1.4 These Conditions may be printed or stored on permanent storage devices, in accordance with the applicable statutory provisions currently in force.

2. How to buy the products

2.1 The products offered for sale by ZEGNA are only and exclusively the ones displayed on the Website when the Order is placed, as described in the relevant product information sheet. 

The images included in the product information sheet are for information purposes only and may not be fully representative of all product specifications. Colours may also differ due to differences in screens and systems used by Customers for accessing the Website.

2.2 Customer can place an Order by duly filling-in the order form made available on the Website and submit it in accordance with the instructions provided therein, after having carefully reviewed these Conditions, the product specifications, the relevant purchase price (inclusive of all applicable taxes and charges), shipping costs (including the ancillary costs that may be incurred in case a shipping and delivery method quicker and/or different from the standard one is chosen). Before placing the order, Customer may correct any errors by amending the information entered in the order form.

2.3 ZEGNA shall confirm that the Order has been properly received by sending an email notification to the address provided by Customer. Such email shall contain a summary of the conditions of purchase in accordance with applicable statutory provisions, as well as the information submitted by Customer in the Order, enabling the Customer to double check such information and, if necessary, immediately report incorrect data, if any. This confirmation does not constitute acceptance of the Order within the meaning of clause 1.2 above.

3. Price and Terms of payment

3.1 The prices indicated on the Website are inclusive of taxes and VAT. Customer shall be informed in advance of shipping costs or applicable fees, if any, through the Website. 

3.2 The payments may be made exclusively through credit card or via PayPal, and the transaction will be processed through a secure server selected by ZEGNA.

3.3 Under no circumstances and at no stage of the payment process, the details of the credit card of Customer will be disclosed to ZEGNA because such details will be directly sent, in a secure manner, to the website of the financial institution in charge of the transaction.

4. Delivery of the products and relevant expenses

4.1 ZEGNA, its suppliers and its logistics service providers shall deliver the products purchased by Customer on the agreed date to the address indicated by the Customer in the Order, at the price expressly indicated on the Website before submission of the Order. 

4.2 Customer may decide to personally collect the products, rather than having them dispatched to him/her, directly at one of the ZEGNA retail stores participating in the “retail store direct delivery” program. A complete list of such retail stores is available on the Website. In this case, Customer will receive a notification informing him/her that the product has arrived at the retail store and is ready for collection. Collection may then take place within 20 (twenty) days from receipt of such notification. For this purpose, a copy of the aforesaid notification together with a valid identification document must be presented. Failure to collect the products within the time limit indicated shall result in the purchase contract be automatically terminated and Customer shall be entitled to a full refund of the purchase price. Since no payment can be made at the retail store, “cash on delivery” payment shall not be available for products purchased in this manner.

5. Right of withdrawal

5.1 Customer is entitled to withdraw from the purchase contract for any reason, without stating any reason, within 30 (thirty) days from the date of delivery of the products, provided that the delivered products have not been manufactured according to the Customer’s specifications or clearly tailored to the Customer’s personal needs. 

5.2 Customer may exercise the right of withdrawal set forth in clause 5.1 above by using the designated form (the "Withdrawal Form") included with the shipment of the relevant product, although use of such form is not mandatory. Customer may submit his/her declaration to ZEGNA by any means of his/her choosing, including by post to the Zegna retail store located at Seitzergasse 6/GL2, 1010 Wien, Austria or by email to customer.care@zegna.com. For any further information or assistance, customers may contact Customer Care at: customer.care@zegna.com, or contact staff directly at a physical shop who may also offer to accept the customer’s withdrawal if the customer returns the products directly at the shop.

5.3 In the event of withdrawal, Customer shall dispatch the products back to ZEGNA within 30 (thirty) days from the date on which the above notice was submitted, following one of the following options:

5.3.1 Send the product/s to be returned via the courier service indicated by ZEGNA in the Withdrawal Form to one of the addresses expressly specified therein (in which case the return shipment is at ZEGNA's exclusive expense);

5.3.2 Send the product/s to be returned via the courier service chosen by Customer to the address expressly specified in the Withdrawal Form (in which case the return shipment shall be at Customer’s exclusive expense);

5.3.3 Return of the products in person at the address expressly specified in the Withdrawal Form (Customer shall return the products together with the Withdrawal Form and upon presentation of a valid identification document).

5.4 The following shall also apply:

  • The products must be returned properly packaged (including, where available, the original packaging materials and accompanying documents as well as any accessories supplied, labels, tags, seals, etc.);
  • The products must be kept with due care until the right of withdrawal is exercised and may only be used to the extent strictly necessary strictly necessary to verify their nature, specifications and size. Furthermore, they must not show any signs of use or traces of dirt;
  • The right of withdrawal may only be exercised in respect of a complete purchased product; partial withdrawals (e.g. with regard to individual accessories, complements, etc.) shall not be permitted.

 

5.5 ZEGNA shall refund to Customer the whole amount already paid by the latter, including standard shipping costs that the same may have incurred in relation to the returned products (exclusive of any additional cost incurred as a result of a different and/or quicker typology of shipping and delivery) within 14 (fourteen) days from the date of the withdrawal. Unless otherwise agreed by the parties, the amount initially charged to Customer shall be cancelled using the same means of payment used by Customer in the initial transaction. In any case, no amount shall be charged to Customer in relation to the refund. ZEGNA may withhold the refund until the returned product is properly received by ZEGNA or until Customer demonstrates that the product has been correctly returned, whichever is earlier.

5.6 Once the products are received, ZEGNA will check them in order to verify that they are consistent with the terms and conditions set forth in this clause. If, upon such inspection, ZEGNA determines that the market value of the products has diminished as a result of handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods, Customer shall be obliged to pay ZEGNA appropriate compensation. In such case, ZEGNA shall inform Customer of the corresponding amount. If, at that time, the refund pursuant to clause 5.5 above has not yet been made, ZEGNA shall be entitled to deduct the amount determined for the diminished market value from the refund; otherwise, Customer shall be obliged to make the corresponding payment, and ZEGNA may charge the payment method used by Customer for the Order accordingly. If Customer informs ZEGNA that he/she wishes the products to be returned to him/her at his/her own expense and in the same condition in which they were received by ZEGNA, ZEGNA shall comply with such request; in this case, provided that the refund has not yet been made, no refund of the amount paid by Customer shall be made.

5.7 In the event that the right of withdrawal is forfeited, ZEGNA shall send back to Customer the purchased product, charging the latter with the relevant shipping costs and, if already refunded, the price of the product.

6. Warranties

The statutory warranty provisions shall apply.

7. Claims and queries

8. Applicable Law/Venue

8.1 The purchase contract under these Conditions and its performance are governed by Austrian Law, without giving effect to the conflicts of law provisions thereof or the United Nations Convention on Contracts for the International Sale of Goods and without excluding the mandatory provisions applicable to Customer under the law of the EU Member State in which the customer has his or her habitual residence.

For actions brought by ZEGNA arising out of or in connection with this agreement:

  • against Customers who have their domicile, habitual residence, or place of employment within the territory of a Member State of the European Union, the competent court shall be the court having jurisdiction over Customer’s domicile, habitual residence, or place of employment;
  • against all other Customers, exclusive jurisdiction shall lie with the court having subject-matter jurisdiction for Munich.

For disputes arising out of or in connection with this agreement brought by Customer against ZEGNA, jurisdiction shall be determined in accordance with applicable law.

8.2 Please note that ZEGNA is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board. If a dispute arises that cannot be resolved, we will inform you, in writing, of the consumer arbitration board with jurisdiction over you.
